Warranty, Terms and Conditions
BloomBoss, LLC (hereinafter “BloomBoss) agrees to supply and the Purchaser, “Purchaser” agrees to purchase goods subject to these terms and conditions.
“Manufactured goods” shall mean those products assembled and/or manufactured by BloomBoss or those products manufactured specifically for resale by BloomBoss. “Non-Manufactured Goods” shall mean an individual product that is sold or distributed by BloomBoss.
Title: Upon payment by Purchaser to BloomBoss of purchase price in full, as set forth on the invoice, title to the Manufactured Goods or Non-Manufactured Goods shall vest to the Purchaser.
Pricing: Pricing is in US Dollars and is subject to change without notice.
Payment Terms: BoomBoss offers payment via MasterCard, Visa and American Express, PayPal, Wire Transfer Facilities or other Prepayment options.
Taxes: Unless otherwise agreed in writing the amount of all taxes or other charges now or hereafter imposed by any government authority upon the sale, purchase, resale, delivery, manufacture, production or possession of the products specified herein which may be paid by BloomBoss or for which BloomBoss may be liable, shall be paid to BloomBoss by buyer in addition to the purchase price of the products.
Shipping: BloomBoss understands the importance of on-time deliveries and makes every effort ship within the specified time frame. Most orders normally ship the same day received, provided the order is received by 2 PM Eastern Standard Time. All orders are shipped F. O. B. BloomBoss’s warehouse unless noted otherwise.
Damaged Shipments: In the rare event your products are received damaged, you must note any damages on the acceptance form from the carrier and notify BloomBoss Support of said damage in writing within (48) hours of receipt. In the event BloomBoss is not notified in the specified time frame, BloomBoss cannot be held responsible for any damages and such claims will be denied.
Missing Items: Please inventory your order upon receipt and notify BloomBoss of any damage in writing within (48) hours of receipt of any missing items. Any claim for missing items initiated more than (48) hours of receipt of the order by the Purchaser will not be accepted by BloomBoss.
BloomBoss Return Policy
30 Day Return Policy for Manufactured Goods: Returns will be authorized within a (30) day period of the original delivery date to the end user.
Non-Manufactured Goods sold by BloomBoss are final sale, unless noted otherwise, received damaged or defective.
The following procedures must be followed for all returns:
Step #1 - Contact BloomBoss Support at (888)-323-7840 with your Invoice Number to receive an RMA number.
Step #2 - Ship the products back to us freight prepaid and insured - write the RMA number in clear characters on the outside of each box sent back. To protect your products from further damage, products must be packaged using the original box and packing material. Damage may be caused to the products if non-BloomBoss packaging is used. BloomBoss assumes no responsibility for damage to any products during shipment from the customer to our factory. All items including hanging kits cables etc. originally shipped with the system must be returned. In the event this system is not returned complete, you'll be charged for the missing items. Products must be in new undamaged condition to receive credit. Credits are processed within (21) days of receipt of returned products.
BloomBoss’s Support Department can usually, with your assistance diagnose and solve most problems over the telephone or via email.
Any alterations, modifications or changes made to your products configuration will not be supported by BloomBoss.
Warranty: BloomBoss warrants that under normal use and service Manufactured Goods shall be free from defects in material and workmanship. The Purchaser’s sole and exclusive remedy for failure of BloomBoss to deliver Manufactured Goods shall be the repair or replacement of any such defective Manufactured Goods by BloomBoss, at BloomBoss’s designated place of business or service area.
In no event shall BloomBoss be liable for any consequential damages or damages of any kind or nature alleged to have resulted from any breach of warranty. BloomBoss does not warrant the merchantability of Manufactured Goods or their fitness for any particular purpose. BloomBoss makes no warranty, express or implied, other than those specifically set forth herein.
BloomBoss Warranty Procedures
Most BloomBoss LED Grow Lights include a 3 year manufacturer’s warranty; however, please consult the specific product listing for complete warranty information for that product.
If you should experience a technical problem with your BloomBoss LED Grow Light, the following procedures should be followed in order to obtain warranty service:
Step #1 - With the serial number of your light ready; please contact BloomBoss Support at (888) 323-7840 or send an email detailing your problem to Support@BloomBoss.com.
Our technicians will attempt to help you solve the problem immediately over the telephone or via email. We may ask you to perform some simple diagnosis procedures. These procedures are necessary before proceeding to Step #2.
Step #2 - If we are unable to rectify the problem over telephone or via email and determine that an in warranty item is defective, we will issue an RMA number for the defective item along with instructions on where it should be returned. Write the RMA number clearly on the outside of each box being returned. Failure to mark the RMA number on the outside of the box may cause the package to be refused and or a delay in shipment a replacements. Pack the item carefully (preferably in the original packaging) and ship it to us freight prepaid and insured.
Step #3 - After receipt of the defective item and at BloomBoss's sole option, we will repair or replace the item. The repair or replaced item will be shipped back to you at our expense via a shipping method of our choice.
If any time prior to, or upon receipt of the defective item, it is determined that the failure is not covered under the warranty, you will be advised of the cost to repair. Upon written authorization by you, we will then repair the item and return it to you, including the cost of repairing all shipping charges.
Limitation of Liability: Under no circumstance shall BloomBoss assume any liability arising out of these terms and conditions or BloomBoss's performance or asserted failure to perform hereunder in contract, tort including negligence or otherwise in excess of the purchase price of the products sold to you by BloomBoss to which such liability relates. In no event shall BloomBoss be liable for special, incidental or consequential damages, including without limitation, damages resulting from loss of use, profits, business, goodwill whether or not BloomBoss has been advised of the possibility thereof.
BloomBoss will not be liable for loss, damage or delay caused by strikes or labor difficulties, lockouts, acts of omission or any governmental party, insurrection, riot, war or similar hostility, fires, floods, force majeure, acts of God, breakdown of essential machinery, accidents, cargo material shortages, delays and transportation, inability to obtain labor, materials or parts or otherwise due to causes beyond BloomBoss’s reasonable control.
A) This contract contains the entire agreement between the parties and supersedes any prior contracts or oral or written agreements between the parties relating to the subject matter hereof.
B) This contract may not be assigned, modified or canceled without BloomBoss's prior written consent and any attempts to assign modify or cancel without the consent shall be void.
C) No delay or omission to exercise any right, power or remedy by BloomBoss upon breach or default by buyer under this contract shall not impair any such right, power or remedy of BloomBoss, or be construed as a waiver of any such breach or default.
D) In the event any provision hereof shall, for any reason, the held void or unenforceable, the remaining provisions shall remain in full force and effect and shall control.
E) All sales of “Manufactured Goods” and “Goods” are limited to and made expressly conditional on agreement by the buyer to the foregoing terms and conditions. BloomBoss expressly objects to and rejects any terms and conditions that may be proposed by buyer which are in addition to or different from the foregoing terms and conditions. These terms and conditions may be amended from time to time, without notice in BloomBoss's sole discretion.
F) These terms and conditions and any subsequent agreement in which they are incorporated, shall be interpreted in accordance with and governed by the laws of the Commonwealth of Massachusetts and BloomBoss and purchaser hereby consent to the sole jurisdiction of the State of Massachusetts courts.
Notices, Requests, Demands and other Communications: All notices, requests, demands and other communication contemplated hereunder shall be in writing and shall be deemed to have been duly given when delivered by US Certified or registered first-class mail, prepared, and addressed to the parties at their principal place of business or at such other addresses as the parties may designate hereafter by written notice.
